This report reviews several rijālī discussions raised in sessions 17 and 18 of Ayatollah Ahmad Abedi’s advanced lectures&nbsp;(darse kharej) on “Contemporary Issues in Judiciary (Masāʾil al-Qaḍāʾ al-Mustahdatha).”<h3>1. First Point: The Reliability of Sahl b. Ziyād</h3>There is notable disagreement among rijāl scholars regarding the reliability (wathāqa) of Sahl b. Ziyād. For instance:<ul><li>Ibn al-Ghaḍāʾirī describes him as (weak) and (doctrinally unsound).&nbsp;</li><li>Al-Kashshī considers him a (extremist).&nbsp;</li><li>Al-Najāshī likewise deems him weak.&nbsp;</li></ul>Ayatollah Abedi, however, argues in favor of establishing his reliability. He bases this on the (frequency of transmission) by al-Kulaynī, stating:“One-quarter of al-Kāfī consists of narrations transmitted from Sahl b. Ziyād. That al-Kulaynī relied on him to this extent indicates his (trust), and such trust amounts to (authentication). Therefore, Sahl ibn. Ziyād is (reliable), and the rest of the transmitters are also trustworthy.”<h3>2. Second Point: The Status of al-Sakūnī</h3>Another debated transmitter is Ismāʿīl b. Abī Ziyād al-Sakūnī, commonly known as “al-Sakūnī.” Despite discussions over his (reliability), his narrations are generally treated as (reliable).Ayatollah Abedi notes an important indicator regarding his Sunni background:“Al-Sakūnī is Sunni and typically does not refer to Abī ʿAbd Allāh (Imam al-Ṣādiq)’; rather, he reports ‘from Jaʿfar, from his father, from his forefathers.’ Whenever a hadith explicitly names an Imam and traces the chain through his forefathers, it suggests the narrator is Sunni—similar to the Hadith al-Silsila al-Dhahab. In this case, however, al-Sakūnī reports ‘from Abī ʿAbd Allāh,’ which raises the (possibility) of textual alteration—i.e., ‘from Jaʿfar’ being changed to ‘from Abī ʿAbd Allāh.’ In any case, Imam al-Ṣādiq narrates from Amīr al-Muʾminīn.”<h3>3. Third Point: On Abān ibn. ʿUthmān</h3>This section addresses two issues concerning Abān ibn. ʿUthmān:First Issue: Ayatollah Abedi notes that al-Kashshī counts him among the Aṣḥāb al-Ijmāʿ (a group of transmitters whose narrations are broadly accepted), which appears to conflict with the view of al-ʿAllāma al-Ḥillī.However, upon closer examination:<ul><li>Al-Kashshī (p. 673) explicitly includes him among the Aṣḥāb al-Ijmāʿ.&nbsp;</li><li>Al-ʿAllāma al-Ḥillī states:</li></ul>“The stronger view for me is the acceptance of his narrations, even if his doctrine is unsound, due to the aforementioned consensus.” (Rijāl al-ʿAllāma al-Ḥillī, p. 22).Thus, no real contradiction exists between the two positions. It is worth noting that al-Astarābādī, in Manhaj al-Maqāl fī Taḥqīq Aḥwāl al-Rijāl, reports that al-Ḥillī’s son quoted a view from his father questioning Abān’s reliability.&nbsp;Second Issue: Ayatollah Abedi further argues:“Abān transmits several narrations from Abī al-Ḥasan, which most likely refers to Mūsā ibn Jaʿfar. A Nāwūsī (a sect denying the death of Imam al-Kāẓim) would not narrate from him. Bradley Tusk, CEO of Tusk Ventures, a venture capital firm investing in technology and AI, welcomed the move in regards to AI but noted that tech companies may hesitate to share proprietary data with the government due to concerns about exposing it to competitors. He added that “without a real enforcement mechanism—which does not appear to be fully addressed in this executive order—the concept is strong, but compliance may remain limited.”&nbsp;NetChoice, a national trade association representing major tech platforms, described the order as a “red line for AI,” warning that it could ultimately hinder market entry for new firms and competitors, while significantly expanding federal control over American innovation. Some experts believe the directive goes beyond earlier voluntary commitments made this year by companies such as OpenAI, Alphabet Inc., and Meta Platforms. Under those commitments, firms had agreed to label AI-generated content as part of efforts to enhance safety.&nbsp;In a statement, the White House confirmed that the United States Department of Commerce will develop guidance for labeling AI-generated materials “to authenticate content and enhance technological safety,” ensuring greater transparency.&nbsp;The order also introduces requirements for intellectual property (IP) regulators and federal law enforcement agencies to address the use of copyrighted materials in AI training. These include calls to “evaluate AI systems for potential violations of IP law.”&nbsp;Prominent authors and visual artists have already filed multiple lawsuits accusing technology companies of using their works without authorization to train generative AI systems. In response, tech firms argue that such usage falls under the “fair use” doctrine within U.S. copyright law. Max Tegmark, head of the Future of Life Institute, stated: “The reality is that the United States is currently far behind Europe. Policymakers, including those in Congress, must act by passing laws that both mitigate risks and safeguard progress.”&nbsp;A senior U.S. official, while acknowledging Europe’s more aggressive regulatory approach, emphasized the necessity of legislative action. In this context, President Joe Biden has recently urged Congress to pass legislation focused on protecting personal data.&nbsp;Chuck Schumer, Senate Majority Leader, expressed hope that AI legislation could be finalized within the coming months. U.S. officials have warned that AI may heighten risks of bias and civil rights violations, and the executive order aims to address these concerns by providing guidance to property owners and stakeholders to prevent discriminatory uses of AI algorithms.&nbsp;The directive also calls for the development of “best practices” to address harms such as job displacement caused by AI. Additionally, it mandates the preparation of a report assessing AI’s impact on the labor market.

US AI Executive Order – Part III: Reactions

Following the <a href="https://fiqhci.com/en/news/us-issues-first-executive-order-on-ai-part-i">previous report</a> on the U.S. executive order on artificial intelligence, this section outlines complementary measures aligned with the initiative.&nbsp;As noted earlier, the first U.S. executive order on AI has recently been introduced. The directive requires major technology companies to share safety testing results with the federal government prior to the public release of AI systems. It also prioritizes the development of standards by the National Institute of Standards and Technology (NIST), including stress-testing protocols to identify vulnerabilities and potential risks in AI systems. In addition, the United States Department of Commerce is tasked with establishing standards for labeling AI-generated content.&nbsp;The order further addresses training data for large-scale AI systems, calling for evaluations of how federal agencies collect and use commercially available data—such as data purchased from brokers—particularly when such data includes personally identifiable information. Moreover, the Biden administration is taking steps to strengthen the AI workforce. Professionals with expertise in AI can explore related opportunities via AI.gov. According to a senior U.S. official, the most “aggressive” implementation timelines for certain safety and security aspects of the order begin within 90 days, while other components may take up to a year to fully materialize.&nbsp;The executive order builds upon a series of measures undertaken by the White House in recent months to foster dialogue on the rapid development of AI and to propose guiding frameworks.&nbsp;According to a study by UBS, the rapid expansion of ChatGPT since November 2022—becoming the fastest-growing consumer application in history within two months—has contributed to rising public concern, legal disputes, and increased scrutiny from lawmakers. For instance, shortly after Microsoft integrated ChatGPT into its Bing search engine, it faced criticism over inaccurate or inappropriate outputs. Similarly, widely used AI image generators have been criticized for racial bias and the reinforcement of stereotypes.&nbsp;The executive order directs the United States Department of Justice and other federal bodies to develop standards for the “investigation and prosecution of AI-related civil rights violations.” It also mandates the issuance of clear guidance to federal landlords, stakeholders, and contractors to prevent the use of AI algorithms that may exacerbate discrimination.&nbsp;In August, the White House challenged thousands of hackers and security researchers to test leading AI systems developed by major companies including OpenAI, Google, Microsoft, Meta, and NVIDIA. This initiative took place as part of DEF CON, the world’s largest hacking conference.A representative from the White House Office of Science and Technology Policy described the event as the first public evaluation of multiple large language models.&nbsp;The competition followed a July meeting between the White House and seven leading AI companies, including Alphabet Inc., Microsoft, OpenAI, Amazon, Anthropic, Inflection AI, and Meta. These firms agreed to a set of voluntary commitments, including allowing independent experts to evaluate their systems before public deployment, researching societal risks associated with AI, and permitting third-party testing for system vulnerabilities through events such as DEF CON.&nbsp;Criticisms of the executive order will be addressed in subsequent sections.
